Driver Terms & Agreement

Draft for final approval — not a binding work agreement.
Version: RMV-DRIVER-DRAFT-20261012-V3 · Prepared 12 October 2026

Selected application: Self-Employed Driver with Own Van

Section A covers the proposed independent own-van arrangement. Sections C–F cover driver operations, safety, data and checks. Section B explains Company Driver and worker/employee rights; a label does not replace assessment of the actual working arrangement.

The complete supplied document is below. Open a section to read it. Company-specific employment particulars, insurance limits and the separate policies in Section G still require approval. Draft confirmation does not authorise work or accept a future final contract.

A. Self-Employed Driver / Transport Partner Agreement

Applies to: Independent Driver with Own Van only. This section does not govern Company Driver or office employment.

1. Parties and purpose

This proposed agreement is between REMOVER MAN AND VAN LTD (the Company) and the independent transport provider identified in the onboarding record (the Driver/Partner). The intended arrangement is transport and removal work by an independent business, rather than employment, only where that reflects the actual working relationship.

2. Genuine self-employment

The Driver operates their own business and is responsible for their tax, National Insurance, business expenses, insurance and equipment. The actual working arrangement determines status: a self-employed label alone does not establish genuine self-employment.

  • Free to accept or reject individual jobs.
  • No guaranteed minimum jobs, hours or earnings.
  • May work for other customers, platforms and businesses.
  • Checks whether a job is commercially suitable before accepting it.
  • Bears business costs and may make a profit or loss.
  • Invoices, or is paid against an agreed job statement, for completed services.

3. No obligation to offer or accept work

The Company is not obliged to offer work, and the Driver is not obliged to accept it. Once a job is accepted, the Driver is expected to complete it unless a genuine safety, legal, medical or operational reason prevents completion.

4. Vehicle requirement

An own-van transport partner must provide and maintain a suitable vehicle for accepted work.

  • Properly taxed, with a valid MOT where required.
  • Roadworthy and suitable for the accepted job.
  • Not overloaded; within all legal vehicle and axle weight limits.
  • Equipped with appropriate load restraints and equipment.

5. Insurance

Maintain the insurance required for the work before accepting jobs. For furniture and removal work, the Company may require commercial motor cover suitable for the activity, hire-and-reward/business use where applicable, Goods in Transit and Public Liability cover.

Market comparison only: AnyVan publishes £10,000+ Goods in Transit and £1 million+ Public Liability cover for furniture/house moves, plus suitable commercial van insurance for hire and reward. These figures are not automatically Remover Man and Van minimums. Any equal or higher Company requirements must be specified before onboarding.

  • Immediately report expired or cancelled cover, changed insurer restrictions, or any loss of cover for the vehicle or relevant use.

6. Driving licence and legal entitlement

  • Hold the correct valid driving licence.
  • Notify the Company of new penalty points, disqualification or restrictions.
  • Permit reasonable licence verification and provide requested licence-check information through an approved secure channel.

7. Right to work

The Company will complete appropriate prescribed right-to-work checks where legally required before work begins. Current Home Office guidance must be applied to the actual direct engagement, subcontracting or platform arrangement; the obligations must not be assumed from a self-employed label. Checks must be consistent and free from unlawful discrimination.

8. Substitution

Where genuinely permitted in practice, the Driver may provide an appropriately qualified substitute, subject to reasonable safety, insurance, legal and customer-security checks. A paper substitution clause does not establish employment status.

  • The substitute must have the correct licence and appropriate right to work.
  • The substitute must be properly insured and meet Company safety and conduct standards.

9. Payment

Proposed Company policy: payment is due within 14 calendar days after the job is marked completed and required completion proof is submitted. Missing evidence or a disputed job may require investigation, but undisputed completed amounts should not be unreasonably withheld.

This is a proposed driver-payment rule, not a change to the customer payment system or an automated payout instruction. For comparison, CitySprint publicly describes weekly courier payments.

  • Job reference and collection/delivery proof.
  • Photographs and customer signature where used.
  • Additional-charge authorisation where applicable.

10. Taxes and VAT

The independent Driver is responsible for Income Tax, National Insurance, VAT registration/accounting where applicable, business records and allowable expenses. The Company does not provide tax advice.

11. Expenses

Unless the job offer expressly says otherwise, the independent Driver pays fuel, normal vehicle maintenance, tyres, routine insurance, phone/data and ordinary business overheads.

The job offer should identify responsibility for tolls, ferries, congestion/ULEZ/LEZ charges, customer-authorised parking and special permits. Fines or penalties resulting from the Driver’s unlawful conduct remain the Driver’s responsibility unless the Company expressly accepts liability in writing.

12. Company customers and off-company payments

Customer details are supplied only for the assigned job. This restriction protects legitimate Company customers; it is not a blanket restriction on working for other businesses.

  • Do not privately solicit Company customers or divert them to personal work.
  • Do not request unauthorised off-platform/off-company payments.
  • Do not keep customer details for future personal marketing.

13. Cancellation by the Driver

Immediately notify the Company if an accepted job must be cancelled. Repeated late cancellations, no-shows or abandonment may lead to suspension or termination. The Company should not impose punitive deductions unrelated to actual loss.

14. Ending the contractor relationship

Either party may end the ongoing contractor relationship. Serious concerns may justify immediate suspension or termination, subject to applicable law and a fair process.

  • Fraud, theft, violence or intoxication while working.
  • Dangerous driving, falsified documents or expired insurance.
  • Serious data misuse or customer harassment.
  • Repeated no-shows or deliberate off-platform customer diversion.

B. Company Driver / Worker or Employee Terms

Applies to: Company Drivers and employment/worker principles for office/general employees. Vehicle, driving and accident clauses apply only where the role involves those activities.

Employment status

A Driver using a Company van, working under Company direction or doing regular expected work must not automatically be labelled self-employed. Assess the real employee or worker status.

Proposed business approach: Company van, Company-controlled schedule and personal service should be treated as an employee/worker arrangement unless appropriate professional advice confirms otherwise. This is an assessment approach, not a legal test that replaces the facts.

1. Written terms

Employees and workers must receive the required main written particulars from the start of work, with further required particulars within the applicable statutory period. Applicant-specific details must be completed in the final approved document.

  • Company and applicant names; role and start date.
  • Pay/rate and frequency of payment.
  • Hours, working days and any variability.
  • Holiday and sick-pay arrangements.
  • Notice, pension information, disciplinary/grievance procedures and training requirements.

2. Pay

The Company will pay at least the statutory minimum applicable at the time for all qualifying working time, including when the statutory rate changes.

Reference at preparation, 12 October 2026: the National Living Wage for age 21+ is £12.71/hour from 1 April 2026. Younger-worker and apprentice bands differ. This reference is not an agreed individual wage or a permanent rate cap.

3. Holiday

Almost all workers are entitled to 5.6 weeks’ paid annual leave, with entitlement calculated or pro-rated under the applicable statutory rules. Irregular-hours and part-year workers’ leave must be calculated using the rules applicable to their arrangement.

4. Pension

Where automatic-enrolment criteria are met, the Company must enrol eligible staff and make the required employer contributions.

5. Employers’ Liability insurance

Where legally required, the Company must hold Employers’ Liability insurance with at least £5 million cover from an authorised insurer. This is a Company obligation, not a requirement for every applicant to purchase such a policy personally.

6. Company vehicle

  • Use the vehicle only as authorised and complete pre-use safety checks.
  • Report damage or defects immediately; do not permit unauthorised drivers.
  • Do not smoke or vape where Company policy prohibits it.
  • Maintain reasonable cleanliness and follow fuel/charging procedures.
  • Comply with parking and traffic law.

7. Company fuel card or other Company card

Use Company cards only for authorised business expenditure. Misuse may be misconduct or gross misconduct depending on its seriousness and the applicable fair procedure.

8. Accidents

  • Stop safely and call emergency services where needed.
  • Exchange legally required details; take photos and record witnesses where safe.
  • Report the incident immediately to the Company.
  • Do not admit civil liability on the Company’s behalf.

9. Disciplinary and grievance

The final employee/worker documents must include or link to fair Company disciplinary and grievance procedures. Those complete procedures still need approval; this application does not replace them.

C. Common Driver Operations & Safety Handbook

Applies to: All Drivers, whether independent, worker or employee. Driver operational requirements do not automatically apply to non-driving office roles.

1. Customer conduct

  • Be polite and professional; do not threaten, insult, harass or discriminate.
  • Do not work under the influence of alcohol or illegal drugs.
  • Do not ask for unauthorised cash or off-book payment.
  • Respect homes and property; use appropriate clothing/PPE where required.

2. Check job information before starting

  • Collection and delivery addresses; floors, stairs and working lift.
  • Parking, access and declared items.
  • Heavy or special items and required crew.
  • Booked dismantling, assembly and packing services.

3. Extra items

Do not silently accept major extra work. Document undeclared items, including photos where appropriate; contact the Company; obtain price authorisation and the customer’s approval before an additional charge.

4. Loading responsibility

Everyone involved must support safe loading and securing. Do not proceed with an unsafe load.

  • Distribute weight safely and avoid axle or gross overload.
  • Place heavy items low and use appropriate restraints.
  • Keep cargo clear of the Driver’s vision.
  • Check restraints during the journey where appropriate.
  • Load against a suitable bulkhead where possible and secure large/heavy items, following applicable DVSA guidance.

5. If the load shifts

Slow down, avoid sudden braking or steering, and stop safely. Do not continue until the load is secure.

6. Manual handling

Never attempt an unsafe lift. Use two people, a trolley/dolly, dismantling or additional authorised crew where needed; refuse unsafe movement. Company risk assessments should cover manual handling, pedestrians/vehicles, falling goods and work at height.

7. Very heavy or special items

Pianos, safes, large stone tables, heavy mirrors/glass, machinery and oversized appliances require suitable authorised crew and equipment.

8. Prohibited goods

  • Do not knowingly carry illegal or stolen goods.
  • Do not carry undeclared dangerous substances, explosives, unlawful weapons, or hazardous materials requiring specialist licences without the lawful specialist arrangements.
  • Do not transport live animals unless specifically approved.
  • Do not accept items beyond vehicle or legal capacity.

9. Collection evidence

Recommended procedure: record the job reference and item count; take condition photos where appropriate; note existing damage; obtain customer or authorised-adult acknowledgement where used.

10. Delivery evidence

Where appropriate, take delivery photos and obtain customer or authorised-adult confirmation. Record a refused or unavailable customer and document alleged damage immediately.

11. Damage

Prevent further damage, photograph relevant areas/items and notify the Company immediately. Provide a factual account; do not promise cash, refunds or compensation.

12. Claims cooperation

Reasonably cooperate with the insurer and Company investigation using photos, job records and statements. Do not falsify or delete evidence.

13. Customer complaints

The Driver should have a fair opportunity to provide their account before ordinary disciplinary or platform action. Serious safety or fraud allegations may justify temporary suspension pending investigation.

14. Waiting time

Follow the customer’s agreed contract: record arrival, allow the agreed free waiting period, try to contact the customer, report prolonged delays and obtain approval to charge or leave. This handbook does not change the existing customer waiting-time rules.

15. Parking

Park legally and safely. A customer’s request does not authorise illegal parking.

16. Children and pets

Customers should keep children and pets away from loading areas. Work may be paused for a genuine safety risk.

17. Smoking, drugs and alcohol

No illegal drugs or impairment while working or driving. The Company may prohibit smoking/vaping in Company vehicles and customer premises.

18. Mobile phones

Do not unlawfully use a handheld phone while driving. Use route and app controls safely and lawfully.

Reference guidance
D. Drivers’ Hours and Fatigue

Applies to: All Drivers, according to the vehicle, vehicle combination, job and applicable exemptions.

Applicable rules

GB domestic rules commonly apply to business goods-vehicle driving that is outside assimilated rules. Where those domestic rules apply, the daily driving limit is generally 10 hours and the daily duty limit is generally 11 hours, subject to the applicable exemptions and definitions. These figures are not permission to ignore rest, fatigue or other legal requirements.

Vehicles or combinations over 3.5 tonnes may fall under assimilated rules, including their break, rest and tachograph requirements. Confirm the applicable regime for the actual vehicle and job.

  • Comply with all applicable drivers’ hours rules and keep required records.
  • Report fatigue and do not continue unsafe driving.
  • The Company must not pressure a Driver to breach safety or hours rules.
  • Organise schedules to allow lawful rest and retain required records.

E. Data Protection & Customer Confidentiality

Applies to: Drivers and employees/workers who handle customer information, limited to what their authorised role requires.

Customer information

Customer names, phones, collection/delivery addresses, item lists, photos and access notes may be provided only as needed for assigned work. Use that information only for the authorised job and necessary records. Keep data adequate, relevant and limited to what is needed.

  • Do not copy customer lists, retain screenshots indefinitely or privately market to customers.
  • Do not share addresses with friends or other businesses.
  • Do not upload customer photos to social media.
  • Do not use customer information after its legitimate need ends.

Lost phone or data leak

Immediately inform the Company of a lost phone, unauthorised access or a data leak. The Company determines containment and the appropriate breach-response steps.
